1. Acceptance of these terms
These Terms and Conditions form an agreement between you and OwningYourHouse, LLC, doing business as OwningYourHouse.com (“OwningYourHouse.com,” “we,” “us,” or “our”). By accessing or using the website, you acknowledge that you have read, understood, and agree to these terms.
If you do not agree, do not use the website or submit information through it. Additional terms may apply to a promotion, listing, account, transaction, partner service, or feature. More specific written terms control for that offering when they conflict with these general terms, except where prohibited by law.
2. Eligibility and permitted use
You must be at least 18 years old and legally capable of entering a binding agreement to use transaction-related features. The website is intended for users in the United States unless we expressly state otherwise.
You may use the website only for lawful personal, household, or legitimate business purposes. The website is not directed to children under 13, and a child’s personal information should not be submitted through a general website form.
3. Our role and services
The website may provide educational content, property information, calculators, forms, program information, advertising, directories, and introductions to independent real-estate, mortgage, title, insurance, construction, home-service, and other professionals.
Unless specifically identified in writing as the licensed provider for a service, OwningYourHouse.com is not the lender, mortgage broker, real-estate broker, real-estate agent, builder, title company, settlement agent, appraiser, inspector, insurer, attorney, tax adviser, or other professional providing that service.
Independent providers control their licensing, eligibility decisions, pricing, underwriting, advice, contracts, and performance. A directory placement, introduction, featured designation, or advertisement is not a guarantee or certification. You are responsible for independently evaluating providers and reviewing their terms.
4. Listings and property information
Listings, prices, availability, photographs, measurements, descriptions, taxes, school data, estimated values, incentives, and other property information may come from owners, agents, brokers, builders, data vendors, public records, or other third parties. Information may be incomplete, delayed, changed, withdrawn, duplicated, or inaccurate.
You must independently verify material facts before relying on them, including ownership, listing status, price, square footage, boundaries, zoning, permits, condition, schools, taxes, insurance availability, association obligations, flood or environmental conditions, and representations affecting your decision.
A property’s appearance on the website does not mean it remains available, that an offer will be accepted, that financing is available, or that a transaction will close.
5. Forms, accounts, and submissions
You agree to provide current, accurate, and complete information. You may not impersonate another person, use another person’s contact information without authorization, or submit false, misleading, fabricated, or fraudulent information.
You are responsible for protecting account credentials and activity through your account. Notify us promptly if you believe an account has been compromised.
Submitting a form is a request for information or contact. It is not an application approval, loan commitment, brokerage agreement, representation agreement, property reservation, guaranteed rebate, or promise of a particular outcome unless a separate written agreement expressly states otherwise.
6. Calls, text messages, and emails
When you provide contact information, we and specifically identified participating providers may contact you as described in the disclosure shown when you submit the information and as permitted by applicable law. The form-specific consent language governs the communications authorized by that submission.
Where you separately opt in to marketing calls or text messages, you may receive recurring communications using manual or automated technology as described in the applicable disclosure. Consent to marketing is not a condition of purchasing property, obtaining a loan, or receiving a service.
Message frequency varies. Message and data rates may apply. Reply STOP to a marketing text to request cancellation and HELP for assistance. Use the unsubscribe option in a commercial email to opt out of marketing email. Transactional or legally required communications may continue where permitted.
You represent that you are the subscriber or customary user of any telephone number or email address you provide and are authorized to consent to communications at that number or address.
7. Rebates and incentives
Qualifying transactions other than new construction
Up to $8,500
Qualifying new-construction transactions
Up to $4,500
The two maximums are alternatives and are not cumulative. New-construction transactions are subject to the $4,500 maximum, not $8,500. “Up to” identifies a potential maximum and does not guarantee that a consumer will receive the maximum—or any benefit.
All benefits are governed by the separate Rebates & Incentives Terms and any offer-specific conditions. Eligibility, availability, transaction type, provider requirements, financing limits, builder or seller restrictions, and applicable law may reduce or eliminate a benefit.
Obtain written confirmation of the specific benefit’s amount, source, form, conditions, and timing before relying on it.
8. Partners, referrals, compensation, and consumer choice
We may introduce users to independent providers or display providers that advertise, sponsor content, participate in a network, purchase lawful marketing services, or have another business relationship with us. A business relationship does not guarantee that a provider is the lowest-cost, highest-rated, or best option.
You remain free to shop for and select your own lender, mortgage broker, real-estate professional, title company, settlement agent, attorney, inspector, insurer, builder, and other service provider, subject to any lawful transaction-specific limitation disclosed to you.
Nothing in these terms authorizes a fee, kickback, payment, or other thing of value in exchange for the referral of settlement-service business. Any compensation connected to covered services must be for actual goods, facilities, services, advertising, or another lawful purpose—not an unlawful referral, unearned fee, or prohibited steering arrangement.
If an affiliated business relationship exists and a separate disclosure is legally required, the responsible party will provide it separately. These website terms do not replace a transaction-specific disclosure.
9. Mortgage, financing, and calculator information
Rates, payments, affordability results, down-payment examples, closing-cost figures, qualification scenarios, and calculator outputs are general estimates. They may omit taxes, insurance, mortgage insurance, association dues, assessments, fees, rate adjustments, or other costs.
Website content is not a Loan Estimate, Closing Disclosure, prequalification, preapproval, credit decision, rate lock, commitment to lend, appraisal, or financing guarantee. Only an authorized provider may make a credit decision or issue transaction-specific disclosures.
Do not submit Social Security numbers, bank credentials, complete account numbers, or similarly sensitive financial information through a general contact or lead form unless the form is expressly designed and secured for that purpose.
10. Fair housing and lawful content
The website may not be used to publish, request, target, communicate, or act upon an unlawful discriminatory preference, limitation, or exclusion relating to housing or housing-related services. Listings, advertisements, messages, and submissions must comply with applicable fair-housing and anti-discrimination laws.
We may reject or remove content that appears discriminatory, exclusionary, harassing, threatening, deceptive, or unlawful. Report concerning content through our contact page.
11. User content and listing rights
“User content” includes listings, photographs, videos, logos, descriptions, documents, reviews, comments, and other material you upload, submit, or authorize us to publish.
You retain your ownership rights. By submitting user content, you grant us a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, format, resize, adapt for technical or promotional presentation, display, distribute, and use it as reasonably necessary to operate, improve, market, and promote the website and applicable listing or service.
You represent that you own the content or have all required permissions; that it is accurate to the best of your knowledge; and that publication does not infringe privacy, publicity, copyright, trademark, contract, confidentiality, MLS, brokerage, or other rights.
You remain responsible for updating or removing content that is inaccurate, expired, withdrawn, sold, leased, unavailable, or no longer authorized. We may edit formatting, request verification, decline publication, or remove content, but are not obligated to monitor every submission.
12. Acceptable use
You may not use the website to:
- Violate a law, regulation, court order, contract, or another person’s rights.
- Submit false leads, fraudulent applications, fabricated listings, or misleading information.
- Harass, threaten, discriminate against, exploit, or impersonate another person.
- Transmit malware, malicious code, spam, unauthorized advertising, or deceptive communications.
- Gain or attempt unauthorized access to an account, server, database, form, or security control.
- Interfere with operation, overload infrastructure, probe vulnerabilities, or bypass restrictions.
- Scrape, crawl, harvest, copy, index, or extract website or listing data by automated means without prior written permission, except ordinary search-engine indexing that honors our technical instructions.
- Use website data to build a competing database, train a commercial model, or resell leads, listings, or contact information without authorization.
- Reverse engineer website software except where applicable law expressly permits it.
- Remove copyright, trademark, attribution, watermark, or proprietary notices.
13. Intellectual property
The website’s design, branding, text, graphics, logos, icons, software, compilations, original photographs, videos, and other content are owned by us or licensed to us and are protected by intellectual-property laws.
We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the website for its intended purpose. No ownership right transfers to you. You may not reproduce, republish, distribute, sell, license, modify, create derivative works from, or commercially exploit protected content without written permission or a lawful exception.
OwningYourHouse.com names, logos, slogans, and distinctive branding may not be used in a manner that implies sponsorship, affiliation, or endorsement without prior written permission.
14. Third-party websites, tools, and services
The website may link to, embed, or integrate third-party websites, forms, mapping services, calculators, listing feeds, social networks, payment services, scheduling tools, analytics, or other technology. Third parties operate under their own terms and privacy practices.
We do not control and are not responsible for third-party content, availability, security, accessibility, pricing, decisions, promises, or performance. A link or integration does not imply endorsement. Review the third party’s terms and disclosures before using its service or providing information.
15. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ALL CONTENT, LISTINGS, TOOLS, INTRODUCTIONS, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, quiet enjoyment, and warranties arising from course of dealing or usage of trade.
We do not warrant that the website will be uninterrupted, secure, error-free, free of harmful components, or compatible with every device or assistive technology; that content will be complete or current; that a provider will contact you; or that a property, financing option, rebate, incentive, or service will be available or suitable.
Website content is general information, not legal, tax, accounting, engineering, appraisal, inspection, insurance, investment, underwriting, or other professional advice. Consult a qualified professional regarding your circumstances.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted and do not limit non-waivable consumer rights.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OWNINGYOURHOUSE.COM AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, DATA, OR OPPORTUNITIES; BUSINESS INTERRUPTION; OR LOSS ARISING FROM A THIRD-PARTY PROVIDER OR TRANSACTION.
To the fullest extent permitted by law, our aggregate liability for all claims arising from or relating to the website or these terms will not exceed the greater of: (a) the amount you paid directly to us for website use during the 12 months before the event giving rise to the claim; or (b) one hundred U.S. dollars ($100).
These limitations do not exclude liability that cannot legally be excluded or limited, including liability for fraud, willful misconduct, or personal injury to the extent a limitation is prohibited by applicable law.
17. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless OwningYourHouse.com and its owners, officers, employees, contractors, affiliates, and agents from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful conduct, material violation of these terms, user content, infringement of another person’s rights, or misuse of the website.
This section does not require a consumer to indemnify us for our own negligence, unlawful conduct, or another obligation that cannot legally be shifted to the consumer.
18. Suspension, removal, and termination
We may restrict, suspend, or terminate access; reject or remove a listing or submission; or discontinue a feature when reasonably necessary to protect users, enforce these terms, respond to legal requirements, address security or operational concerns, or prevent suspected fraud or abuse.
You may stop using the website at any time. Provisions that by their nature should survive—including intellectual property, disclaimers, liability limits, indemnification, dispute terms, and accrued obligations—will remain in effect.
19. Privacy and accessibility
Our Privacy Policy explains how personal information is collected, used, disclosed, and protected. By using the website, you acknowledge that information will be handled as described there and in form-specific disclosures.
We aim to provide a website reasonably accessible to users with disabilities. Accessibility feedback and requests for assistance may be submitted through our contact page. Please identify the page, feature, assistive technology, and barrier encountered.
20. Copyright complaints
If you believe material on the website infringes your copyright, send a written notice to info@owningyourhouse.com containing:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed.
- Identification and location of the allegedly infringing material.
- Your name, mailing address, telephone number, and email address.
- A statement of good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the notice is accurate and you are the copyright owner or authorized to act for the owner.
Knowingly making a material misrepresentation in a copyright notice may create liability. This procedure does not itself register or maintain a designated DMCA agent.
21. Disputes and governing law
Before filing a lawsuit, you and OwningYourHouse.com agree to make a good-faith effort to resolve the dispute informally. A written notice should describe the issue, relevant facts, requested relief, and contact information. Send notices to info@owningyourhouse.com and 3956 Town Center Blvd Ste 143, Orlando, FL 32837.
Unless non-waivable law requires otherwise, these terms are governed by the laws of Florida, without regard to conflict-of-law rules. Any court proceeding must be brought in a state or federal court located in Osceola County, Florida, and each party consents to that court’s jurisdiction and venue.
These terms do not limit rights or remedies that applicable consumer law does not permit you to waive. No mandatory arbitration provision or class-action waiver is included in these terms.
22. General provisions
Changes to these terms
We may update these terms to reflect legal, operational, security, or service changes. The revised version will display a new “Last updated” date. Material changes apply prospectively unless the law permits otherwise. Continued use after the effective date constitutes acceptance of the revised terms.
Severability
If a provision is held unenforceable, it will be enforced to the maximum lawful extent or severed, and the remaining provisions will continue in effect.
No waiver
A failure to enforce a provision is not a waiver. A waiver must be in writing and applies only to the specific instance stated.
Assignment
You may not assign these terms without our written consent. We may assign them in connection with a merger, reorganization, sale of assets, financing, or transfer of the website or business, subject to applicable law.
Entire agreement
These terms, the Privacy Policy, the Rebates & Incentives Terms, and applicable feature- or transaction-specific written terms constitute the agreement regarding website use and supersede prior website-use understandings.
Electronic communications
You consent to receive these terms, notices, and records electronically. You may print or save a copy for your records.
